Purchasing off-plan or pre-construction property in Montenegro is highly popular due to attractive entry-level pricing and strong capital appreciation potential. Buyers can secure premium units at a discount compared to completed properties. However, buying off-plan requires careful legal and financial due diligence to manage developer risk.
Step 1: Legal Audit of the Project
Before signing any agreements or depositing funds, your lawyer must review the developer’s credentials and project permissions:
- Building Permit (Građevinska Dozvola): Confirm that the developer has obtained all necessary municipal planning permissions and environmental clearances.
- Land Title: Verify that the land is owned by the developer and is free of mortgages, restitution claims, or legal disputes.
- Utility Agreements: Confirm that the project has official connections for water, electricity, and sewage infrastructure.
Step 2: Structuring the Payment Plan
Never pay the full purchase price upfront. A standard off-plan contract structures payments across construction milestones:
- Reservation Deposit: Typically €5,000 to €10,000 to remove the property from the market.
- First Installment: 30% to 40% paid upon signing the Main Purchase Agreement before the notary.
- Milestone Installments: 20% to 30% paid upon completion of structural works (concrete frame, roof).
- Final Installment: 10% paid only upon delivery of keys, final registration, and municipal technical acceptance (upotrebna dozvola).
Step 3: Developer Guarantees
- Bank Guarantee: Reputable developers provide a bank guarantee that protects your payments if the project fails or is delayed.
- Penalty Clauses: Ensure the notary contract includes clear penalty clauses that compensate you for completion delays beyond the agreed grace period (typically 3 to 6 months).
